However, it does signal the end of a legal detention at this type of checkpoint, unless the agent has consent or probable cause that a crime has been or is being committed.

Why would you want to obstruct if you support the patrol of the border. The agent put it very well, the are protecting the back field. Now coming from common sense. Why would you do this for over 25 minutes and cause the hassle. It is sad that it is necessary for the U.S. to have these checkpoints but it is. As American Citizens we have to bite the bullet and comply. I bet if this guy was to have, God forbid, a loved one killed by an illegal immigrant then he would claim the USBP failed.

Here is my opinion on this matter. I am a Criminal Justice student and have had several classes in law. This checkpoint was LEGAL and was authorized by the U.S. Supreme Court as acknowldged by our “victim” in the video. While stopped at a checkpoint the agents have the right to ask for identification because they are peace officers. They should have asked for identification in the first place but instead went for the simple route and asked if he was an American Citizen.

Been there, done that djjnicko. Even been in court and won as a result of protecting my 4th amendment rights at checkpoints. As such, I’m not impressed with your working definition of ‘probable cause’ and ‘facts’.
In ‘fact’, I have an entire YouTube channel, blog and website chock full of checkpoint videos, legal decisions and research that make the point far better than any series of 500 character comments on YouTube ever could.
